Oyster Terms of Service

    Oyster ("Oyster," "we," "us," or "our") provides administrative tools designed to assist users in discovering, organizing, and preparing class action settlement claims.

    Oyster is operated by an independent sole proprietor located in Alberta, Canada.

    By accessing or using the Oyster mobile application, website, or related services (collectively, the "Service"), you agree to these Terms of Service ("Terms").

    If you do not agree, do not use the Service.

    1. Service Description

    Oyster provides tools that: Display publicly available settlement opportunities; Open official settlement claim websites within the app; Autofill certain user-provided information where technically possible; Assist with organizing and tracking claims. Oyster is not a law firm and does not provide legal advice. No attorney-client relationship is created. All claims are submitted directly by the user on official settlement administrator websites. Oyster does not represent users in legal proceedings. Users remain solely responsible for reviewing and submitting all claim information.

    2. Eligibility

    You must be at least 18 years old to use the Service. By using Oyster, you represent and warrant that: You are legally capable of entering into binding agreements; All information provided is truthful and accurate; You are filing claims only on your own behalf unless legally authorized.

    3. Geographic Scope

    Oyster is designed primarily for users participating in U.S. class action settlements. Eligibility and availability vary by jurisdiction and settlement terms. We do not guarantee that any specific claim is available or applicable to you.

    4. No Legal Advice or Guarantee

    Oyster does not: Provide legal advice; Guarantee claim approval; Guarantee payout amounts; Guarantee payment timing; Guarantee eligibility. All claim determinations are made solely by settlement administrators and courts.

    5. Fees and Payment Model

    Oyster may offer parts of the Service without upfront charges, subscription requirements, or setup fees. If Oyster introduces paid features or changes pricing, those terms will be disclosed clearly before they apply. Users are responsible for reviewing the current pricing and product terms at the time they use the Service.

    6. User Responsibilities

    You agree not to: Submit false or fraudulent information; Impersonate another person; Misuse settlement processes; Attempt unauthorized access; Reverse engineer or copy proprietary systems. You are solely responsible for the accuracy of submitted claim information.

    7. Account Security

    You are responsible for: Maintaining login credential confidentiality; Securing your device; Promptly reporting unauthorized access. Oyster may suspend or terminate access to protect users or system integrity.

    8. Privacy

    Use of the Service is governed by our Privacy Policy, available at: https://oysterclaim.com/privacy. Optional integrations (including Gmail) are read-only and limited to claim-related detection when enabled.

    9. Intellectual Property

    All software, systems, branding, design, and content associated with Oyster are proprietary. You may not: Copy or redistribute the Service; Reverse engineer the application; Create derivative works.

    10. Limitation of Liability

    To the fullest extent permitted by law: Oyster shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service. Direct liability, if any, shall not exceed the total fees paid to Oyster for the specific service event giving rise to the claim.

    11. Indemnification

    You agree to indemnify and hold harmless Oyster and its operator from any claims, damages, liabilities, and expenses arising from: False information submitted by you; Misuse of the Service; Violation of these Terms.

    12. Dispute Resolution and Arbitration

    Informal Resolution: Before initiating formal proceedings, you agree to first attempt to resolve disputes informally by contacting founder@oysterclaim.com and providing a written description of the issue. Both parties agree to attempt good-faith resolution for at least 30 days. Binding Arbitration: Except for matters eligible for small claims court, any dispute arising out of or relating to these Terms or use of the Service shall be resolved by binding individual arbitration conducted in Alberta, Canada. Arbitration shall be conducted in accordance with applicable arbitration rules in Alberta. The arbitrator shall have exclusive authority to determine the enforceability of this arbitration provision. Class Action Waiver: You agree that disputes will be resolved on an individual basis only. You waive any right to participate in class actions, collective actions, or representative proceedings. Small Claims Exception: Either party may bring individual claims in small claims court where eligible. Opt-Out Right: You may opt out of this arbitration provision by sending written notice to founder@oysterclaim.com within 30 days of first accepting these Terms.

    13. Governing Law

    These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles.

    14. Electronic Consent

    You agree that: Electronic communications satisfy legal requirements; Electronic acceptance constitutes binding agreement; Notices delivered electronically are valid.

    15. Changes to Terms

    Oyster may update these Terms periodically to reflect operational, legal, or security changes. Continued use of the Service after updates constitutes acceptance of revised Terms.
